Welcome to GolfWink! These Terms of Service ("Terms") govern your use of our mobile application ("App") and any related services provided by GolfWink ("we," "us," or "our"). By creating an account, purchasing a subscription, or using our App, you agree to be bound by these Terms.

1. Subscription Services

Our App is offered on a subscription basis. We offer various subscription plans ("Plans") with different features and pricing. Your chosen Plan will be billed in accordance with the terms of that Plan, as disclosed at the time of purchase.

2. Billing and Payments

Subscriptions are managed and billed through the Apple App Store or Google Play Store. All payments are processed by the respective platform and are subject to their terms and conditions. You must provide a valid payment method to purchase a subscription.

3. Automatic Renewal

To ensure uninterrupted service, your subscription will automatically renew at the end of each billing cycle unless you cancel it. You can manage or cancel your subscription through your App Store or Play Store account settings at least 24 hours before the renewal date.

4. Cancellations and Refunds

You may cancel your subscription at any time. The cancellation will take effect at the end of the current billing period. All purchases are final and non-refundable, except as required by applicable law or as determined by Apple or Google in their sole discretion. Refund requests should be directed to the platform where you made the purchase.

5. User Accounts

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Intellectual Property

The App, including its content, features, and functionality, is owned by GolfWink and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Prohibited Uses

You agree not to use the App for any unlawful purpose or to engage in any activity that could harm the App, our services, or other users. Prohibited activities include, but are not limited to, reverse-engineering the App, infringing on intellectual property rights, or distributing malicious software.

8. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, GolfWink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.

11. Governing Law

These Terms shall be governed by the laws of the State of Wyoming, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
